Terms of Service

whimsy.cards ("the Service", "we", "us", "our") is a digital card and memory platform that allows registered users to create, customise, and share digital story cards for personal occasions such as birthdays, anniversaries, weddings, and more. The Service is available at etherealstories.com.

You must be at least 16 years old to create an account. You agree to provide a valid email address and to keep your account credentials confidential. You are solely responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

You retain full ownership of all photos, text, and other content you upload to the Service ("User Content"). By uploading User Content you grant whimsy.cards a limited, non-exclusive, royalty-free licence to store, process, and display it solely for the purpose of delivering the Service to you. We do not claim ownership of your content, and we do not use it for advertising, machine learning, or any other purpose.

Publishing requires a one-time payment. Prices are displayed in RON. The displayed price is the total and final amount payable and includes all applicable taxes, if any. At the date of these Terms, the operator is not registered for VAT and therefore does not collect or separately state VAT. If the tax status changes, the final price shown before payment will include applicable VAT unless expressly stated otherwise. Payments are processed by Stripe; we do not store card details. Delivery is digital and immediate after payment, with access through the account and a confirmation email.

You must verify text, dates, images and configuration in the mandatory preview and ensure uploaded content is lawful and does not infringe third-party rights. Do not use custom RSVP fields to request health, religion or other special-category data without an appropriate legal basis. Digital invitations remain available until you delete them; deleted invitations are purged within 48 hours. RSVP responses are retained for no more than 12 months or deleted sooner with the invitation/account.

If you enable RSVP, guest data is collected on your behalf. You are ordinarily the controller for the form's purpose and content and must provide guests with the required information and a lawful basis. whimsy.cards processes that content on your instructions, while acting as an independent controller for security, abuse prevention and its own legal duties. Guest data is not used for our marketing.

You agree not to use the Service to upload, create, or share content that: infringes any third-party intellectual property or privacy rights; is unlawful, defamatory, abusive, threatening, or harassing; contains malware, harmful code, or phishing material; impersonates any person or entity; or violates any applicable law or regulation. We reserve the right to remove content and suspend accounts that violate these rules.

The whimsy.cards name, logo, templates, platform design, and all related intellectual property are the exclusive property of whimsy.cards. You may not copy, reproduce, modify, or distribute any part of the platform or its templates without our prior written consent.

We take reasonable steps for availability and security, but temporary interruptions may occur for maintenance, incidents or causes outside our reasonable control. This does not exclude liability for obligations attributable to us. Third-party outages do not automatically remove our responsibility; we take reasonable steps to prevent, limit and remedy their effects.

Any limitation applies only to the extent permitted by law and does not restrict mandatory consumer conformity rights, data protection rights, or liability that cannot legally be excluded or limited. You remain responsible for third-party claims caused by unlawful content you provided, to the extent permitted by law.

We may suspend or terminate access where you breach these Terms, use stolen payment methods, upload unlawful content, attempt unauthorised access or create accounts to evade restrictions. Measures will be proportionate where possible and do not remove mandatory legal rights.

We may update these Terms for legal, security, technical or service changes. The version governing an order is the one shown and accepted when the order is placed. Changes do not retroactively reduce rights for completed orders. Where required, active users will be informed before a material change takes effect.

Romanian law applies, without depriving consumers of mandatory protection provided by applicable law. We encourage contacting contact@etherealstories.com first. Consumers may also use ANPC's alternative dispute resolution procedures at https://anpc.ro/ce-este-sal/. Competent courts are determined under applicable procedural law.
